SCOTUS Cuts Back EPA Authority Over Water Pollution

In a case brought by the city of San Francisco against the Environmental Protection Agency, the Supreme Court sided with the city and made it harder for the EPA to constrain water pollution.

On behalf of the majority in the decision, Justice Samuel Alito wrote that EPA is allowed to set specific limits on what can be discharged. (San Francisco’s case involves release of raw sewage during heavy rain.) But the Court rules the EPA cannot set limits that “include ‘end-result’ provisions”  holding a city or county responsible for the quality of the water that wastewater goes into.

The decision aligns with Donald Trump’s desire to wipe away as many regulations as possible.
