NY Doctor Indicted for Online Prescription in Louisiana

A Louisiana grand jury indicted a doctor in New York for allegedly prescribing an abortion medication online for a patient in Louisiana.

A grand jury for District Court in Baton Rouge indicted Dr. Margaret Carpenter, her company and another person. The charge is felony abortion by means of abortion-inducing drugs.

This appears to be the first criminal case since the 2022 overturning of Roe v. Wade where charges involve a doctor sending abortion medication across state lines. An earlier lawsuit brought against the same doctor by the state of Texas for the same activity was not a criminal case.

In Louisiana, abortion is almost totally banned, including by the medications mifepristone and misoprostol.

New York has a shield law designed to protect doctors who prescribe such medications through telehealth for patients subject to abortion bans in their states. This indictment will test the shield law.
