Federal Transportation Funds Become Conditional on Various State Policies Aligning with DJT

Newly appointed Secretary of Transportation Sean Duffy issued a memo declaring that federal transportation funds will be linked with state compliance to White House policy dictates for various non-transportation policies.

Examples include denying transportation funds to states that impose vaccine or face mask mandates to reduce disease, and to states where local authorities do not go along with federal immigration policies or agents.

Preference for transportation funding will go to “communities with marriage and birth rates higher than the national average” and “utilize user-pay models,

At least two other federal agencies are rumored to be in line to impose unrelated conditions for dispersal of their funding.

This appears to fly in the face of at least one Supreme Court finding that conditions imposed for the release of federal funding must be relevant to  federal aims for the projects involved. Such conditions can entice but not coerce.
