Lawsuits Filed Against DOGE

Minutes after Donald Trump was sworn into office as President, three lawsuits were filed challenging the legality of his planned .Department of Government Efficiency (DOGE).

DOGE is to be led by Elon Musk and was proposed to sit outside the government rather than an actual government agency, yet take an axe to federal programs, regulations, budgets and the workforce.

The lawsuits filed by lodged by Public Citizen, the State Democracy Defenders Fund and the American Federation of Government Employees said without authorization by Congress, DOGE could only be an advisory committee, not a federal agency. But as an advisory committee, it would not satisfy the Federal Advisory Committee Act of 1972 (FACA). It meets behind closed doors, does not make a public record of its meetings available and is not required to be composed of members with “fairly balanced” viewpoints. Each of those violates FACA.
