Judge Reinstates Gwynne Wilcox on NLRB

Federal District Court Judge Beryl Howell reinstated Gwynne Wilcox on the National Labor Relations Board, ruling that Donald Trump’s abrupt firing of her was illegal.

Wilcox and NLRB’s general counsel Jennifer Abruzzo were fired 27 January 2025. Wilcox sued. Her attorneys argued that NLRB members can only be fired “for neglect of duty or malfeasance in office,” with notice and after a hearing.

Howell wrote, “An American president is not a king — not even an ‘elected’ one — and his power to remove federal officers and honest civil servants like plaintiff is not absolute.”
