Judge Lifts DJT’s Tariffs from Two Companies that Sued Against Them

Federal District Court Judge Rudolph Contreras ruled that Donald Trump’s unilaterally imposed tariffs are unlawful and lifted them from the companies whose lawsuit is before him while the case progresses.

This is the second court in less than 24 hours to issue a finding that the International Economic Emergency Powers Act does not give Trump the tariff authority he has presumed to wield.

Contreras also denied the Trump regime’s request to move the case to the Court of International Trade, which issued a more sweeping repudiation of the tariffs last night. That decision has already been appealed, and the Court of Appeals for the Federal Circuit already reinstated Trump’s tariffs while it considers the case.

Contreras’ ruling protects the plaintiffs before him, Learning Resources, Inc. and hand2mind, Inc., from the action of the Court of Appeals even if it overturns the Court of International Trade decision. His ruling is certain to be appealed, but that will go to the Court of Appeals for the DC Circuit which may not see the issue in the same way as the Federal Circuit.

The issue is likely to rise to the Supreme Court.
