Judge Incredulous at DOJ’s Inability to Answer Basic Questions About DOGE

Federal District Court Judge Theodore Chuang expressed considerable skepticism at the Department of Justice’s inability to answer basic questions about the structure and leadership of DOGE.

Chuang is hearing a lawsuit by 26 employees and contractors of U.S. Agency for International Development against Elon Musk and his organization DOGE, citing violation of the Constitution’s appointments clause and separation of powers.

Musk and Donald Trump consistently referred to Musk as leading DOGE until lawsuits were filed asserting that he is wielding powers not permitted to an appointee who lacks Senate confirmation and is also violating separation of powers. After the lawsuits were filed, the White House eventually named Amy Gleason as the leader of DOGE, but Musk continues to be referred to as though he is in charge of it.
