USAID Employees and Contractors Sue Elon Musk and DOGE

Twenty-six employees and contractors of U.S. Agency for International Development filed a lawsuit in federal District Court against Elon Musk and his organization DOGE, citing violation of the Constitution’s appointments clause and separation of powers.

On the same day, a similar lawsuit was filed in a different federal District Court by a coalition of 14 states.

The lawsuit asserts the Department of Government Efficiency, which is a subset of a White House IT team rather than a government department, does not have the necessary constitutional legitimacy for its activities. DOGE has been cancelling contracts, slashing budgets and instigating mass firings of federal civil servants.

The crux of the case is the same basis that undercut Special Counsel Jack Smith in the Mar-a-Lago documents case.
