Judge Delays “Deferred Resignation” Deadline

Federal District Judge George A. O’Toole Jr. ordered a pause until Monday for the deadline of midnight tonight that was dictated in an email purporting to offer “deferred resignation” to federal employees.

O’Toole further ordered the government must notify, today, all employees who received the offer that its deadline is extended.

O’Toole is handling a lawsuit filed on behalf of unions representing more than 800,000 federal employees. The lawsuit says the resignation offer is not legal and is “arbitrary and capricious in numerous respects.” The government has submitted a brief in the case. O’Toole gave the unions until close of business Friday to respond and scheduled a hearing for Monday at 14:00 to consider the case on its merits.
