DJT Fires NLRB Board Member & Its General Counsel

With immediate effect and without legally required assertions of transgressions, Donald Trump fired a board member of the National Labor Relations Board, leaving it unable to act, and fired NLRB general counsel.

NLRB is the federal watchdog regarding labor issues. Appointments to its board must be confirmed by the Senate.

Gwynne Wilcox, fired by Trump, was the first Black woman to serve on the NLRB board. She was its chair under Biden. Trump made Republican board appointee Marvin Kaplan chair last week. However, without Wilcox the board cannot meet quorum, so it is not able to do anything.

The law that authorizes NLRB only allows the President to fire members of its board in the event of negligence of duty or malfeasance, thus protecting NLRB from both a bad actor on its board and the political winds of a Presidential transition. Trump did not offer a reason for the firing that comports with the law.

Trump also fired NLRB’s general counsel Jennifer Abruzzo. Deputy general counsel Jessica Rutter has become acting general counsel.
