Appeals Court Upholds District Court Block of DJT’s Attempt to Limit Birthright Citizenship

A panel of the 1st Circuit Court of Appeals unanimously upheld a federal District Court’s block of Donald Trump’s executive order to limit birthright citizenship, which would infringe on the 14th Amendment to the Constitution.

This is the third Appeals Court ruling against the Trump regime on this issue. The particular case before the 1st Circuit was brought by 22 state Attorneys General. Federal District Court Judge Leo Sorokin in Massachusetts issued an order in that case blocking Trump’s executive order.

The 1st Circuit appellate court did not rule about the legality of the lower court’s block. However, its Chief Judge David Barron wrote that the Department of Justice made no “developed argument” for why Trump’s order should be legal and rejected the DOJ’s assertion that the states which sued did not have standing to do so.
