Appeals Court Disallows DJT’s Firing of Federal Reserve Governor Lisa Cook

A panel of the Circuit Court of Appeals for the District of Columbia left in place a Federal District Court judge’s ruling that Donald Trump’s accusations of mortgage fraud against Federal Reserve Governor Lisa Cook are not sufficient grounds to fire her.

The government has not produced any evidence to support its allegations against Cook. Evidence has come forward from mortgage application paperwork and local property tax authorities supporting her innocence.

The Federal Reserve is specially structured to insulate its Board against political pressure. Trump can only remove a Governor from its Board for cause. No President has ever removed a Governor from the Board. Cook is the first black woman to serve on the Board.

In addition to so far not showing sufficient cause, the Appeals Court found that he denied Cook due process. “Before this court, the government does not dispute that it provided Cook no meaningful notice or opportunity to respond to the allegations against her.”

The government appealed the ruling. Trump has also ordered the Department of Justice to conduct a criminal mortgage fraud probe into Cook, and orchestrated grand jury subpoenas in Georgia and Michigan.
