14 States Sue DJT and Elon Musk to Rein In Musk

Fourteen states jointly sued Donald Trump, Elon Musk and Musk’s DOGE in federal District Court, saying the White House gave Musk and his team an  unconstitutional amount of authority and power.

The group of Democratic-led states assert Musk’s role should require advice and consent by the Senate to satisfy the Appointments Clause of the Constitution. Musk is unelected and unconfirmed. His Department of Government Efficiency is not a Congressionally created department of government. It is organized as a subset of a White House IT team.

The case was assigned to District Court Judge Tanya Chutkan, who scheduled an initial hearing for 16:00 on 14 February 2025.
