Supreme Court Upholds Law That Bans TikTok

In an unsigned unanimous decision, the Supreme Court upheld the Court of Appeals for the DC Circuit to allow the Protecting Americans from Foreign Adversary Controlled Applications Act to take effect Sunday 19 January 2025. This decision sides with Congress and the Department of Justice in deeming TikTok a threat to USA national security.

Although the Biden administration deferred enforcement to the Trump administration that will be sworn in the next day, TikTok began disappearing from USA app stores after the decision was announced. About 170 million people in the USA use the app. Under the new law, it will be banned in the USA unless it is sold from its current Chinese ownership to American ownership.

Announcement of the decision caused a surge in downloads of Xaiohungshu (which translates from Mandarin as Little Red Book), known as RedNote in Engliah, instead. It is Chinese-owned, collects large amounts of user data, does not keep its data on USA-based servers as TikTok does, and in its terms and conditions requires users to comply with “basic principles” of the Chinese Constitution.
