SCOTUS Pauses DJT Request and Leaves Dellinger In Place at Head of OSC

The Supreme Court paused an emergency request from Donald Trump, who wants to fire Hampton Dellinger from his role as head of the Office of Special Counsel.

OSC fights political corruption, shields government whistleblowers.and protects federal employees. Trump’s termination notice to Dellinger in the middle of his term of appointment gave no reason for firing him. By law, the head of the OSC can only be removed by the President for nefficiency, neglect of duty, or malfeasance.

Dellinger sued. Federal District Court Judge Amy Berman Jackson issued a temporary restraining order to reinstate him until she holds a hearing 26 February 2025 on the case. Trump appealed. The appeals court rejected the appeal. Trump then filed an emergency request to the Supreme Court.

SCOTUS’ pausing of the request leaves Jackson’s TRO in place and Dellinger continues in his job at least until the hearing.
