Refugee Challenges UK’s Ban of Citizenship Based on Arrival Method

A refugee has filed the first legal challenge against UK’s decision to ban refugees who arrive in the UK by “irregular” means from ever gaining citizenship.

The Afghan complainant arrived in the UK aged 14, escaping from the Taliban. He was smuggled into the UK in a lorry. From there, he progressed through refugee status to indefinite leave to remain after the requisite five year wait, and was due to apply for UK citizenship at the first of March. He is now 21.

The UK’s announced new guidance prohibits him from ever achieving citizenship. It states, “Any person applying for citizenship from 10 February 2025, who previously entered the UK illegally, will normally be refused, regardless of the time that has passed since the illegal entry took place.”

Tens of thousands of people are in a similar situation.
