OSC Seeks to Reinstate 5000 Fired Workers at USDA

Hampton Dellinger, head of the Office of Special Counsel, petitioned the Merit Systems Protection Board to reinstate 5000 probationary workers fired from the U.S. Department of Agriculture.

Dellinger argued that the firings violated civil service protections by being done en masse, saying it was “based on your performance” without any actual indication of poor individual performance or conduct that would make them unsuitable for federal employment.

If granted, reinstatement would be for 45 days to allow Dellinger to investigate further.

Dellinger previously obtained agreement from a court that the firings of six probationary federal workers at six agencies were illegal. This case expands the scope of the legal groundwork he is building in federal District Courts.

Both Dellinger and one of the three members of the MSPB, Cathy Harris, were reinstated in their jobs by courts after being fired by the Trump regime.
