NLRB and MSPB Officials Reinstated Again by Full Appeals Court

The D.C. Circuit Court of Appeals, sitting en banc, voted 7-4 to set aside a ruling by one of its three-judge panels. The court reinstated, for the second time, Gwynne Wilcox to the National Labor Relations Board and Cathy Harris to the Merit Systems Protection Board.

Both agencies are involved in employee grievances and labor disputes.

It is highly unusual for a full Court of Appeals to overturn a ruling by one of its panels.

By law, the two officials can only be dismissed for “inefficiency, neglect of duty, or malfeasance in office.” Donald Trump did not give any such reason for firing them on his first day returning to the White House.

Federal District Court judges ordered them reinstated. A three-judge panel of the Circuit Court of Appeals upheld their firings, which turfed them out of their jobs again. Being reinstated again is probably not the end of their travails. Trump is likely to appeal to the Supreme Court.
