NC Supreme Court Temporarily Halts Curing of 61,000 Ballots

The North Carolina state Supreme Court temporarily blocked a lower court’s ruling that gave about 65,000 voters 15 days to “cure” their ballots from November 2024 to avoid having them discarded, potentially changing the election result for one of its own associate justice positions.

The Court also stayed removal from the count of more than 200 ballots.

The Court is deciding whether to take up the case again after having sent it down to lower courts earlier for normal processing.

Court of Appeals Judge Jefferson Griffin, a Republican, is still challenging his loss by 734 votes to incumbent Democratic Associate Justice Allison Riggs despite two recounts.

Most of the ballots Griffin wants discarded are from members of the military stationed overseas or civilian voters abroad. A few hundred are from citizens who vote from abroad and have never lived within the USA.

The state Supreme Court ordered the North Carolina Board of Elections not to certify the election until all legal appeals are complete. The Board and Riggs asked the Supreme Court to issue a stay and Griffin did not object. Griffin’s complaint is also in the federal court system at the 4th Circuit Court of Appeals.

Griffin has yet to provide evidence that any of the voters he is challenging voted illegally or were ineligible to vote. Even Griffin’s own political party has pushed back against him.

Riggs has recused herself from the matter at the state Supreme Court.
