Lawyers for Abrego Garcia Request Court Sanctions Against Government

Kilmar Abrego Garcia’s filed a request with federal District Court Judge Paula Xinis to sanction the federal government for contempt of court by imposing fines, compel release of documents withheld as state secrets or appoint a special master to delve into “willful noncompliance” with court orders.

For several weeks the government dodged orders from courts including the Supreme Court to return Abrego Garcia to the USA after wrongfully renditioning him to prison in El Salvador without due process and against the orders of an immigration judge who had ruled if he were ever to be deported, he must not be sent to his native El Salvador because he would probably be targeted for persecution by gangs there.

In court, the government claimed to have no power to bring him back and repeatedly requested extensions on time limits. In secret, it used that time to generate an indictment against him for human smuggling. In less than a day after he was retrieved to the USA, he faced that indictment in federal court in Nashville, Tennessee.

Abrego Garcia’s lawyers wrote in the filing, “The Government’s defiance has not been subtle. It has been vocal and sustained and flagrant.”

The government has requested that Xinis dismiss the case.
