Guatemalan Immigrant Reunited with Newborn Daughter and Discharged

Erika, a Guatemalan woman who crossed the border, gave birth, and was separated from her baby in detention, has been reunited with her daughter and discharged from custody.

Soon after she gave birth, Immigration and Customs Enforcement separated her in detention from her daughter Emily. Federal authorities, the Tucson Medical Center where Emily was born, and local officials were inundated with outraged phone calls. Protesters outside the hospital demanded that she be released.

She was initially flagged for expedited removal with her child despite that child being a USA citizen who is only a few days old. Public outcry seems to have prompted her release 3 May 2025, after which she was moved to Phoenix briefly. The International Rescue Committee, which provides humanitarian aid, helped her get into a hotel there. Next a friend helped move her to Tennessee.

Her lawyer Luis Campos said she awaits her first appearance in front of an immigration judge. She is expected to request asylum from violence and instability in Guatemala.

Campos told The Independent “In the end, it was a grassroots effort that turned the tide. I think Tucson served as a good model for what the people can do on the ground level. [….] So there was a complete reversal. I think that the community had a significant, if not probably more than significant, part in securing that reversal.”

Arizona Governor Katie Hobbs, a Democrat, is reported to have intervened on Erika’s behalf also.
