Federal Appeals Court Rejects DJT Emergency Request to Reinstate Partial Ban of Birthright Citizenship

Federal Appeals Court Judge Danielle Forrest did not agree with the government that reinstatement of Donald Trump’s executive order is an emergency and was not convinced the appeal has a good chance of succeeding on the merits.

The 14th Amendment to the Constitution established birthright citizenship. The lawsuit that led to the restraining order Trump wants lifted was filed byAttorneys General in Arizona, Oregon and Illinois. The government is almost certain to appeal to the Supreme Court in its quest to create carve-outs from the 14th Amendment.
