DOJ Appeals Judicial Order to Retrieve Mistakenly Deported Kilmar Abrego Garcia

The government asked the 4th Circuit Court of Appeals to suspend an order by federal District Court Judge Paula Xinis to retrieve wrongfully deported Kilmar Abrego Garcia from El Salvador by no later than 7 April 2025 at 23:59.

The government asserted that no judge in the USA had authority to order the government to retrieve Abrego Garcia because he is no longer within the nation.

Legal scholars immediately weighed in through social media. If the government could wash its hands of responsibility for its errors by simply shipping a person out of the country and then claiming it could not do anything to rectify its errors, the rule of law is irreparably broken.
