Appeals Court Rejects HHS Twice and Leaves Order In Place to Continue Legal Services for Immigrant Children

The 9th Circuit Court of Appeals rejected the Department of Health and Human Services appeal of a temporary restraining order on procedural grounds, then rejected a request from HHS for en banc consideration, so restoration of funding for legal representation for unaccompanied immigrant children is still ordered.

The TRO was issued 1 April 2025 and extended 10 April after plaintiffs informed the court that the government was not complying.

HHS filed its appeal 12 April 2025 to set aside the TRO. On 18 April a panel of the Appeals Court said the TRO is not appealable. HHS then asked for the entire Court to hear its appeal. The Court quickly refused.

The order to reinstate the funding remains in force. The District Court judge who issued it has ordered further hearings and briefings.
