Appeals Court Denies DJT Request to Pause Rehiring Order

The 9th Circuit Appeals Court denied, by a vote of 2 to 1, a Department of Justice request to pause District Court Judge William Alsup’s order to reinstate fired probationary workers at six federal agencies.

Although the court did not rule on the legality of the firings, it said, “Given that the district court found that the employees were wrongfully terminated and ordered an immediate return to the status quo ante, an administrative stay of the district court’s order would not preserve the status quo. It would do just the opposite — it would disrupt the status quo and turn it on its head.”

The court ordered that written briefing must be finished by Thursday on the DOJ’s motion to block Alsup’s ruling, pending full appeal.
