Alina Habba Announces Charges Against Congressional Representative LaMonica McIver

Interim U.S. Attorney for New Jersey Alina Habba announced in social media that she charged Congressional Representative LaMonica McIver (D-NJ) with two counts of assaulting, resisting, and impeding law enforcement officials.

Habba previously served as a personal attorney for Donald Trump and as counselor to him in the White House.

The only prosecutor for the case is Department of Justice attorney Stephen Demanovich. In federal court in New Jersey he has only been involved in this case and the misdemeanor case against Newark Mayor Ras Baraka which has been dropped.

McIver learned about the charges through Habba’s social media post, not through normal channels. McIver said, “Earlier this month, I joined my colleagues to inspect the treatment of ICE detainees at Delaney Hall in my district. We were fulfilling our lawful oversight responsibilities, as members of Congress have done many times before, and our visit should have been peaceful and short. Instead, ICE agents created an unnecessary and unsafe confrontation when they chose to arrest Mayor Baraka.”

Video of the episode outside Delaney Hall shows aggression only by federal agents, and only incidental contact with officers by the Mayor, Congressional Representatives and protestors.
