Wilcox Sues Against Removal from NLRB Board

Gwynne Wilcox sued Donald Trump and Republican board chair Marvin Kaplan of the National Labor Relations Board for removing her from the board in contravention of law. She seeks reinstatement.

Removing her left NLRB’s board unable to meet quorum and therefore unable to do its work. The manner of her removal could only be upheld by courts if the Supreme Court overturns its decision from 1935 in Humphrey’s Executor v. US.
