McConnell’s Stay of Funding Freeze Upheld by Court of Appeals

The 1st Circuit Court of Appeals unanimously rejected an emergency appeal by Donald Trump, which sought to brush aside District Court Judge John McConnell’s order that Trump’s sweeping freeze of most federal funding.

A temporary restraining order such as McConnell’s normally cannot be appealed. The Department of Justice sought an “administrative stay” to block it anyway. Appeals Court judges David Barron, Julie Rikelman and Lara Montecalvo questioned whether the stay is even legal at this point and said the DOJ did not provide justification for it.
