Judge Reminds DJT that Fast-Track Deportations to Libya Would Violate His Injunction

In response to an emergency motion by lawyers representing a group of immigrants facing rapid deportation to Libya, which is not their country of origin, Federal District Court Judge Brian Murphy issued a ruling that such a deportation without due process would violate his existing injunction issued 18 April 2025.

In his emergency order, Murphy barred such deportation to Libya or Saudi Arabia. His existing injunction applies nationwide and to all third-country deportations. An emergency order about any specific third country should not have been necessary.

Donald Trump’s deportation machine sent at least one immigrant to Rwanda while a temporary restraining order by Murphy was in effect, but before he elevated his order to an injunction. Third-country deportations have also been done to Panama, and third-country renditions have been done into a notorious prison in El Salvador.

Homeland Security Secretary Kristi Noem announced on Tuesday that she established new agreements with El Salvador and Colombia to send third-country deportees there. Officials have told reporters, without authorization to speak publicly about the matter, that similar deals are being considered with such countries as Benin, Angola and Eswatini. All of the African countries involved so far have recent histories of civil war, violence, and/or appalling records on human rights.
