Judge Denies Order for Emergency Release of Méndez

Federal District Court Judge Joseph N. Laplante denied an emergency motion for immediate release of Juan Francisco Méndez a day after an immigration judge dismissed the case against him due to failure by the Department of Homeland Security to file charging documents.

In mid-April Laplante ordered immigration authorities to provide 72 hours to Méndez’ lawyers transferring him anywhere.

In case something like this might happen to thwart the release he ordered, Immigration Judge Donald Ostrom scheduled a 15 May bond hearing. If Méndez is not released by then, the hearing may provide another path to achieve his release.
