Judge Blocks Termination of Protected Status for Haitians

Federal District Court Judge Brian Cogan kept in place the 2024 extension of temporary protected status (called parole) for up to 500,000 Haitians in the USA.

In February, Homeland Security Secretary Kristi Noem ordered that TPS for Haitians will end 3 August 2025 instead of 3 February 2026. Noem later published in the Federal Register on 1 July 2025 notice that TPS will end for Haitians effective 2 September.

Cogan ruled Noem’s action unlawful, failing to honor aspects of the TPS statute that call for early notice to recipients and bar termination until after expiration of a previous extension. He wrote, “Secretary Noem cannot reconsider Haiti’s TPS designation in a way that takes effect before February 3, 2026.”

Cogan’s decision may not last long. In May, the Supreme Court lifted a similar blockage regarding TPS for Venezuelans and allowed Donald Trump to end it.
