Judge Blocks DJT’s Asylum Ban

Federal District Court Judge Randolph Moss granted summary judgment (in part) and certified a class to block Donald Trump’s 20 January 2025 executive order which essentially halted access to asylum at the border with Mexico.

Implementation of the order is paused until 16 July to allow the government time to file an appeal.

Moss said the Immigration and Nationality Act defines the “sole and exclusive” ways for the government to deport immigrants who enter the country illegally. No matter how Donald Trump’s regime regards the process, it is the process that must be used. Trump cannot establish “an alternative immigration system” by fiat with no basis in law.

“Nothing in the INA or the Constitution grants the President … the sweeping authority asserted in the Proclamation and implementing guidance. An appeal to necessity cannot fill that void.”

Moss’ ruling applies to all people “who are currently present or who will be present in the United States” and might confront restrictions challenged by the case.

In a separate ruling he will address similar claims by people who have already been deported using procedures he deemed illegal.
