DOJ Unable to Remove Judge from Venezuelan Deportation Case

Federal Appeals Court turned down a request from the Department of Justice to remove District Court Judge James Boasberg from a case against Donald Trump’s use of the Alien Enemies Act to deport more than 260 Venezuelan immigrants to an El Salvador prison.

The DOJ had asked Boesberg to cancel a hearing set for 17:00 in which Boesberg intended to probe whether the government defied his order of 15 March 2025 in its deportation flights of that date. Boesberg refused to cancel.

With both avenues to avoid the hearing thwarted, DOJ had to attend the hearing.
