DJT Sues Federal District Court System in Maryland

| 0

Donald Trump’s regime filed a lawsuit against practically the entire federal District Court in Maryland: all fifteen District Court Judges, a clerk of court, and one of the court’s administrative officials.

The regime also asked to have the clerk’s office at the 4th Circuit Court of Appeals randomly choose a judge from separate district to handle the case or move the case to a different district.

The crux of the lawsuit is that voters gave the President a mandate for mass deportation and courts are in his way. The case is an obvious effort to wipe out the ability of federal District Courts to act as a check on Trump’s power to expel people from the USA without due process.

The suit especially aims for an immediate injunction against a ruling by District Court Chief Judge George Russell III which established a standing order for each petition of habeas corpus filed by an immigrant to challenge their detention. The order prohibits deporting the immigrant for two business days after the petition is filed, which can be extended at the court’s discretion.

This is intended to protect the immigrant’s right to due process, which a recent Supreme Court ruling said the immigrant must have, despite the court being flooded with such petitions due to the ferocious pace of Trump’s mass deportation campaign. The petitions are often filed outside normal court hours. Needing to respond to them immediately created scheduling nightmares for the court.
