Court Warns Pentagon to Take No Action Against Transgender Military Members While Appeal is Heard

The D.C. Circuit Court of Appeals warned the government to take no action against transgender members of the military while an appeal is heard about a judge’s order to block them from being banned.

Federal District Court Judge Ana Reyes issued an order to prevent the military from refusing to enlist transgender people in the military. The Department of Defense filed a motion 21 March 2025 to dissolve her order. She denied the motion.

The DOD appealed to the Circuit Court. The court’s administrative stay is not based on merits of the case. It is to avoid changing the status quo before the legal system to finishes considering the appeal.
