Appeals Court Keeps In Place Order Barring DOGE from Sensitive Social Security Data

The 4th Circuit Court of Appeals dismissed the Department of Justice’s appeal against federal District Court Judge Ellen Lipton Hollander’s temporary restraining order barring DOGE from access to sensitive Social Security data.

Elon Musk’s “Department of Government Efficiency” is a subset of a White House IT team, not a government department.

The case will proceed in District Court, where a motion for a preliminary injunction is expected later in the week. TROs are not usually appealable. Injunctions are appealable.

The TRO prohibits DOGE and anyone associated with it from accessing Social Security data which contains personally identifiable information. It also orders DOGE to delete any such data they already accessed.
